Andrew, if there is any agreement about money or other consideration changing hands, that's a commercial charter.

If OTOH you are advertising for guests who are free to step off at any point without owing you anything--that's guests.

"Sail with us for a week, you WILL pay a share of expenses" that's a commercial charter. It really is that simple, the obligation and agreement make the difference. Whether you are doing it under the radar and informally, or not, doesn't matter until you're called on it.
