If that's the basis of the complaint, it may have been evident to the officers that the operator of the runabout had not been drinking. In our state breath tests are voluntary, unless there has been an accident with serious bodily injury or death, at which point you will find yourself in the back of a cruiser headed for the hospital to get some of your blood.
