If Perdock was doing 95 MPH on the road while under the influence and ran a red light and killed somebody, how would that be dealt with? It seems like this would compare quite well to doing doing 40 - 60 MPH at night, while under the influence, and without maintaining a proper lookout.

I don't get what Dinius did wrong other than having .12 instead of .08 BAC. There have to loads of people out there boating right now with a BAC of .12. Would each of them get 3 years in jail for boating under the influence if they were caught? Dinius was at the helm and there is no evidence of any wrong doing on his part, especially since the boat was hit from the stern. The captain may have been at fault for not having the navigation lights on as it was originally thought. But it is nearly certain that at least the cabin lights were on and most likely the navigation lights were on too.

How do you go to jail for 3 years for being out boating with a .12 BAC while not being at all at fault for the accident?

edit: I guess he didn't go to jail, but how could he even be accused of such a thing?
