You guys don't waste time with written contracts for crew. A contract will not serve any practical purpose in hiring a casual crew. Unless possibly in a long-term passage (for several months or more) where there will be significant financial commitments on both sides, in which a written contract helps memorialize the financial business. But for trips inside say, a month, a contract will only have the potential of creating more issues than it was intended to resolve. In other words, the captain/crew relationship on a recreational sailboat is not a legal relationship. If you didn't hire the right crew, and your 100 miles offshore, what are you going to do if you have a dispute...file suit?! If you pick the wrong crew then take responsibility for your bad judgment, live out your side of the bargain, and end the relationship as soon as practical.
Actually, if the Captain is hiring the crew to do a delivery. The relationship is covered under the Jones Act.
There isn't a device on this world that can measure the indifference I have for that statement.
