Bismarck Dinius Files Suit Against Lake County

I hope Bismarck Dinius's attorneys take Lake County, Russell Perdock and the rest to the cleaners. They tried to railroad him for vehicular manslaughter instead of going after Russell Perdock, the real killer.

Lake County News | California - Dinius seeks $1 million in federal lawsuit against Lake County, local officials

You know what the first rule of sailing is? ...Love. You can learn all the math in the 'verse, but you take
a boat to the sea you don't love, she'll shake you off just as sure as the turning of the worlds. Love keeps
her going when she oughta fall down, tells you she's hurting 'fore she keens. Makes her a home.

This will be interesting to follow. My prediction: Settlement and gag order.

Considering that the DA and Sheriff's department are currently being investigated for corruption and other things... I doubt this will get swept under the rug unless they settle BIG.

When you hear a story like this that sounds such a completely and totally clear-cut case of corruption, you have to assume that there are two sides to the story. And since the County is sticking largely to their "no comment" line, you're forced to use your imagination to come up with what the other side is.

But I swear to God, I can't conjure up a really compelling story from the County's perspective where they don't come out looking like absolute villains.

BoatUS has a write up about it here. Particularly galling is this little gem from the DA:

"We can’t prove beyond a reasonable doubt that [Perdock's] speed was the cause of the accident."

But somehow they felt they could prove that Dinius' intoxication was?

We followed Bismarck's case on Sailing Anarchy for the whole two years, and many of us sent him or his attorney money, and corresponded with some of the Lake County locals who knew what was going on. "Sailors stick together" was the watchword against the overreaching of the county law enforcement and prosecutors.

A local jury cleared him. I hope the federal jury will aim the rifle, that for so long had been pointed at Dinius, at the CYA locals who unfairly went after him as the 2-knot sailor and gave a pass to the 40-knot go-fast sheriff who ran him down from astern and killed an innocent woman in the cockpit, right back at the real wrongdoers. The photos of that O'Day 27 after the collision will set your teeth on edge.

Good luck to him in the SF federal court. It's long overdue.

Meanwhile, California A.G. Jerry Brown, who's office is allegedly investigating the situation, as come up with...?

Now he's running for Governor (again). Hmmm...

They intentionally tried to ruin his life. To save a piece of dirt. I hope he gets enough to go sailing every day he wishes, and not ever work again........i2f
