Supreme Court Sides With Tiverton YC
 
Dealing a blow to objecting neighbors, the Rhode Island Supreme Court on Thursday, March 24, handed down a decision affirming the right of the Tiverton Yacht Club(TYC) to rebuild its burned-down clubhouse and to operate a marina on Riverside Drive.

That's not news. The news was last year, when "The Tiverton Town Council amended zoning of that property in fall 2010 to facilitate construction, rendering the Superior Court ruling moot."

The court case effectively ended when the zoning was amended last year. That the court didn't dismiss the case a that time, probably means someone forgot to call and tell them the good news.

Its actually better that they didn't dismaiss the case. Until a court decisivly rules the case is still unsettled. Once a court issues a ruling, it becomes case law and is permanent. (unless overturned by a still higher court).

If you read the article you will read that the court actually relied on the rezoning to make that part of the suit moot.

What they actually ruled on was the running of the marina.

That lawyer neighbor must be a piece of work.
