OK Folks, Is this a loophole or am I not thinkings of everything?

Lets say I want to take people out for sunset cruises on my sailboat, I can't now because I don't have a Captains License but if I offered a Striper fishing trip via a 34 ft sailboat and we drug a fishing lure around wouldn't all I need is a fishing guide's license? According to Arkansas Game and Fish Website a fishing Guide license is: "Required of a resident who guides, aids or assists another person for pay or other consideration in the taking of fish."

Surely I'm missing something here, but if not I've already got my slogan: "When you are tired of catching fish elsewhere come expierence Sail-fishing with me. We probably won't catch any fish but it's always a good time"

Keep in mind this is an inland lake in Arkansas that I'm talking about.

I believe you are talking about two different things.

One is a fishing guide license...from the short bit that I read on your states website, it would be above and beyond the requirements for operating the vessel. Interestingly enough, the fishing guide permit, does not allow YOU to fish...only to guide others in doing so. That would be yet another license, if you wanted to fish and guide.

In addition you would need a boating license to operate the vessel...and probably a Captains license to take passengers for hire. Your state may waive the state boating license requirement to those who hold captains licenses. ( USCG)

But don't hold me to my interpretation, I'm 1,000 miles away.

In Arkansas there is no boating license required but if you were born after a certain date you are required to have a Boater's Education Certificate. Also, according to the AG&F, a fishing guide is not required to have a Captains License to take "clients" out on his/her boat.

So... I'm thinking I might be on to something here but if so why do I still have this sneaky feeling that I'm missing something??
