|CapnBilll||Its actually better that they didn't dismaiss the case. Until a court decisivly rules the case is still unsettled. Once a court issues a ruling, it becomes case law and is permanent. (unless overturned by a still higher court).|

That's not news. The news was last year, when "The Tiverton Town Council amended zoning of that property in fall 2010 to facilitate construction, rendering the Superior Court ruling moot."
The court case effectively ended when the zoning was amended last year. That the court didn't dismiss the case a that time, probably means someone forgot to call and tell them the good news.
