If you read the article you will read that the court actually relied on the rezoning to make that part of the suit moot.

What they actually ruled on was the running of the marina.

That lawyer neighbor must be a piece of work.

CapnBilll Its actually better that they didn't dismaiss the case. Until a court decisivly rules the case is still unsettled. Once a court issues a ruling, it becomes case law and is permanent. (unless overturned by a still higher court).
