Do the Right Thing

For those who have forgotten Border Patrol Agents Ramos and Compean have now spent 2 years in jail for doing there job and shooting a drug smuggler in the butt. I ask all to please contact the White House as well as your Congressman and Senator and politely ask President Bush to commute the sentences of these men. Without President Bush's intervention these men are facing another 9 and 10 years respectively.

I think a Presidential pardon requires the conviction be over five years old, so these guys may not qualify.

You know what the first rule of sailing is? ...Love. You can learn all the math in the 'verse, but you take
a boat to the sea you don't love, she'll shake you off just as sure as the turning of the worlds. Love keeps
her going when she oughta fall down, tells you she's hurting 'fore she keens. Makes her a home.

Not sure where you found that, but really the only thing limiting a pardon by the President of the United States is whether the crime being pardoned was against the US and whether the person ACCEPTS the pardon, in the case of impeachment.

Don't forget there is a difference in a pardon, and commutation....

Article II, Section 2 of the U.S. Constitution states:
“The President…shall have Power to Grant Reprieves and Pardons for Offenses against the United States, except in Cases of Impeachment.”

Ford pardoned Nixon who had yet to be tried.

Meanwhile, I have yet to be pardoned by my wife for having held her head under the comforter after I ripped one over the holidays.

Need to add something... as far as my study of the Constitution goes, I think the pardon is the ONLY unchecked power of the Executive. Everything else is checked by either the Legislature or by the Supreme Court system.

The President's power is a check to the Judiciary.

So, there is a good chance if he will break down and just do it, he CAN pardon them.

Bush Considering Pardon for Border Agents Convicted of Shooting Mexican Drug Runner

FOXNews.com - Bush Considering Pardon for Border Agents Convicted of Shooting Mexican Drug Runner - Politics | Republican Party | Democratic Party | Political Spectrum

Sunday, January 21, 2007

Jan. 17, 2007: Former U.S. Border Patrol agents Ignacio Ramos (left) and Jose Alonso Compean (right) turn themselves in to federal authorities.

WASHINGTON — President Bush promised to review a case for a possible pardon of two former U.S. Border Patrol agents serving time in prison for shooting a Mexican drug runner.

Bush said in an interview with KFOX-TV in El Paso, Texas, Thursday that he would "take a sober look at the case" as it works its way through the appeals system.

"There are standards that need to be met in law enforcement and according to a jury of their peers, these officers violated some standards," Bush said. "On this case, people need to take a tough look at the facts, the evidence a jury looked at, as well as [the] judge. And I will do the same thing."

Ignacio Ramos and Jose Alonso Compean reported to prison Wednesday to begin serving their sentences for the 2005 non-fatal shooting of Osvaldo Aldrete Davila. Ramos faces 11 years and one day while Compean will serve 12 years. Davila fled to Mexico after he was shot in the buttocks and later admitted he was transporting over 700 pounds of marijuana in the U.S. illegally.

Rep. Duncan Hunter, R-Calif., introduced a bill to pardon the agents, joining a growing group of supporters of the men, including Reps. Dana Rohrabacher, R-Calif., and Ted Poe, R-Texas.

"There's a compelling case that this was an extreme injustice," Hunter told FOXNews.com.

Hunter, a potential 2008 White House contender, said he collected 72 co-sponsors on a bill within 15 minutes after he introduced the measure on the House floor. The bill is the first of its kind in Congress, said Hunter spokesman Joe Kasper. The legislation is likely to head to the House Judiciary Committee for consideration.

"There's nothing to lose because these gentlemen are already in prison," Hunter said, who has met with the agents' families and urged the White House to get involved.

Hunter also sent a letter to the director of the Federal Bureau of Prisons requesting the two former agents be segregated from the general prison population — some of which the ex-agents may have helped put away.

Ramos and Compean were fired after their convictions on several charges, including assault with a deadly weapon, obstruction of justice, and a civil rights violation.

Sen. John Cornyn, R-Texas, sent a letter to Senate Judiciary Committee Chairman Sen. Patrick Leahy, D-Vt., requesting an oversight hearing for a "public explanation and opportunity for questioning."

"I write to urge you to continue to conduct vigorous oversight of the federal government's commitment to protecting Americans who live and work along the border," Cornyn said in his letter.

Cornyn said he and Sen. Arlen Specter of Pennsylvania, who chaired the committee last year, investigated the case and that his office personally interviewed prosecutor Johnny Sutton.

Compean and Ramos were convicted by a jury last March of violating the civil rights of Davila when they shot him on Feb. 17, 2005, in Fabens, Texas, about 30 miles east of El Paso, then tampering with evidence by picking up shell casings from the shooting.

The ex-agents say Davila had a gun, and that's why they fired at him, but a gun was never found.

In exchange for his testimony against the two agents, Davila was granted immunity from prosecution by the U.S. government for attempting to smuggle nearly 750 pounds of marijuana, which had a street value of more than $1 million, into the United States on the day he was shot. He was treated in a U.S. hospital and is now suing the federal government for $5 million, Poe said.

(That article is a year old, and obviously well under the "five year limit" stated in the other post - which is why I posted it)

Compean finally speaks from behind prison bars. Border agent pleads for your help in getting Bush to grant pardons

by Chelsea Schilling
© 2009 WorldNetDaily

Imprisoned agent Jose Compean

Imprisoned Border Patrol agent Jose Compean is finally speaking out from behind bars, asking for America's help in contacting President Bush for an 11th-hour pardon.

In a letter sent exclusively to WND from the Federal Correctional Institution in Ohio, Compean urged supporters to continue contacting the White House so he and fellow imprisoned agent Ignacio Ramos may reunite with their families before the president leaves office.

There's still time to help! Send a FedEx letter to the president asking him to help Ramos and Compean.

His letter says:

I want to thank all of you for your support. The amount of cards and letters I have received has been incredible.

Although our case received attention before we reported to prison, I truly believed people would forget all about us. Once we reported to prison, I was very happy to see how wrong I was. I have received thousands of letters from people all over the country. I have also received letters from other countries such as Italy and even a few from soldiers fighting in Iraq and Afghanistan.

All of these letters have given me a lot of hope. Knowing that people have been praying for us has also given me a lot of strength. Your prayers have really helped me get through some tough times, especially after the appeals court ruled against us. Reading my mail that night made me feel much better.

I want to apologize to a lot of you. As I said earlier, I have received thousands of letters. When I first started getting them, I was able to respond to all of them. The number of letters increased and it is almost impossible to respond to every one. I wanted to, but I wasn't able to keep up.

These last two years have been very hard for my family and me. This has affected us in so many different ways. We have lost two years of our lives that we will never get back.

One of the best memories I have is from my visit with Patty, my wife, and our kids last September. We were all sitting down, playing a board game. For the first time in a very long time, it felt like we were a family. It was great.

As Patty told WND, "God will not throw something at you that you cannot handle."

This has made our family stronger, as well as brought Patty and I much closer. When I feel down or discouraged, I lean on my wife for support. She has done a great job at home with our kids. I am very proud of her, and I love her with all my heart.

Thank you again for everything you have done to help. Words are not enough to express how grateful my family and I are.

I ask that you continue to contact the White House on our behalf these last few days before President Bush leaves office. I also ask that you continue to pray for our families. Hopefully Ignacio and I will be home soon.

God bless you and your families.

Sincerely,

Jose A. Compean
