legal question reguarding my sailboat

Does anyone know if my sailboat is protected under the homestead laws if I live aboard. In matters related to liens, bankrupt's,?? IRS.

I live aboard in Florida and wonder if anyone has any experience with this,

I am not an attorney (nor do I know the attorney who wrote the article). Based on what he wrote, it looks like your boat is not protected by the homestead exemption unless it is permanently docked and not in a condition to be moved by water. However, depending on the value of the boat, how much you owe on it, and your other assets you might still be able to keep it. You'll need to talk to a bankruptcy attorney to figure out the best way to do it.

The boat section is at the bottom of the page; take a look at "Bankruptcy Basics" on the left hand menu to see the other exemptions that may be applicable.

I wish I could talk to someone who has been threw this My daughter and I really do live on the boat, it is not worth much in this market, but to us its our home.

a florida bankruptcy attorney is the only one who can tell you for sure
probably worth the 1 hour consultation to find out

Most local Bar associations including Sarasota County have a referral service where you can consult an attorney for low fee ($25) for 30 minutes. They will not read or look at any documents, you explain your situation and they give you their opinion on what your options are. I've used these services before and it an inexpensive way to get an opinion that's better than a free one. See the Bar's website I've attached, good luck.
