Go Pee In Your Own Cup - A Good Decision

The Federal Court Tells Florida’s Governor Scott To Go Pee In His Own Cup. Law Found Unconstitutional

In a recent decision, it appears the federal court agrees with the ACLU on the fact that requiring welfare recipients to submit to drug testing is unconstitutional. I thought so too, though am happy to see that belief upheld in US courts

Interesting that submitting to a whiz quiz before you receive welfare constitutes "suspicionless search" and violates the 4th amendment, but a search before you can fly does not. Not only are we required to submit to a suspicionless search, but opting to step out of line and not fly instead of being searched is grounds for arrest.

Groping the genitals of toddlers is ok, giving welfare recipients a good reason to not trade their welfare checks for drugs is not. Got it.

My guess, the planes and quite possibly the airports from which they operate are not government operations. Therefore the actions in question are being undertaken by someone not from the government and, as such, are not subject to the Constitutional restrictions placed upon them. Not that I actually support how crazy the US has become in regards to "airline safety". We're getting bad here too, but not (yet) to USA grade problems.

Either way, regardless of what you think about other issues, I find this to be a good decision.

If I collect a check from the Public coffers, it none of your damn business how I spend your money!!

If the federal court had found all drug testing ( by employers, law enforcement etc.) to be unconstitutional, I could possibly understand, but to exempt welfare recipients from the same laws we all have to obey is completely absurd. Especially given the fact that the taxpayers paying for welfare are having to pee in the cup to do so....
Why shouldn't the same rules apply to all? Want something ( job, welfare,etc.), go pee...
How come the ACLU isn't taking up this cause for EVERYONE??

Someone ought to check to see if having a welfare system is constitutional!!!

That would obviate the need to do a pee test.

Not that I agree with the decision, but the arguments go like this:

EMPLOYER: If you want to access my site and work for me, you must pee in this cup. Otherwise, good day to you.

WELFARE RECIPIENT: Those benefits are my right as an American citizen; it is not proper for you to place any hurdle between me and my checks.

Again, it's not that I agree. Our welfare system is out of control and the world should have sharp corners.

Interesting discussions.

The studies showed that less than 5 % ( of the test case) tested positive. The taxpayer would be liable for the expense of all the negative testing..for the 95% + that are tested as drug free.

From a business perspective it would cost the taxpayer even more to cull out the 5 %

Does a 5 % or less positive sampling..constitute an unreasonable search of the 95 % + drug free users...The court says yes. Further the stats show that the 5% seem no less likely to go to work.

The way I read the ruling it is based on facts and statistics not on principle. Had the state demonstrated that..say 45% of welfare recipients tested positive, the ruling might have gone the other way?
