Rule 21

Rule 3 states A "power-driven vessel" means any vessel propelled by machinery. Therefore the sailing vessel with sails up, engine running in neutral cannot be a "power-driven" vessel.

Another point in the discussion, the correct name for steaming light is "Masthead light" Rule 21

I can hear it now, "But Judge, I can't be guilty." I was motor sailing along and just before the collision I shifted to neutral and yelled starboard thereby changing me from the give way boat, to the stand on boat.

Rule 16 The Give Way vessel ...shall take early and substantial action to keep well clear.

Once you determine you are the give way vessel, you must keep clear. The Regulations make no mention of changing your status. A Give Way vessel is a Give Way vessel until there in no longer a risk of collision.

Here is a court case in which a finding had to be made. Notice that whether or not the transmission on Triptych was engaged mattered.

The horn might not be necessary, but it is prudent.

In my reading, point 5.3 indicates it did not matter if Triptych was propelled by machinery or not. Barossa, as the overtaking vessel, was required
to keep out of the way until finally past and clear.
