Re: Rights during USCG Inspection.

The Constitution allows the people to be free from "unreasonable" searches and seizures. Thus, police can search when "reasonable."

Why would anyone consent to an "unreasonable" search?

Why is...

Re: Rights during USCG Inspection.

Kiss the government's behind, or it will ruin your boat. Yes, I think that is my point.

Re: Rights during USCG Inspection.

I listed what I thought our rights currently are.

The point about the dissent is that the Supreme Court is currently tugging between only having to identify yourself if reasonably suspected of a...

Re: Rights during USCG Inspection.

The right to free speech is a right against government action, not private action. So, if I don't like your speech, I am free not to transact with you.

Innocent people also have the right to be...

Re: Rights during USCG Inspection.

Yes, they are good for a year here. Just holding it up and claiming I was boarded was good enough for them.

Re: Rights during USCG Inspection.

Because I boat in an area where the USCG boards as a matter of routine. There is no fault involved. If you boated here, you would be boarded.

I hope that helps.

Re: Rights during USCG Inspection.

I can recall 6. Probably more. Lately the USCG has been trying to inspect every boat once per year.

I must say that they have been very professional, unlike my experience with the Chicago...

Re: Rights during USCG Inspection.

Exercising your rights not to talk to the government is not "being a jerk."

If a cop asks to search your trunk, and you say "no," you are not "being a jerk," you are "being an American."

Re: Rights during USCG Inspection.

I meant that if you were sailing, they can make you heave to. A few of the times that I was boarded, I was actually motoring slowly just like you, and we kept our pace per their instruction.

Re: Rights during USCG Inspection.

Oh, I read it. That is why I posted this discussion. Your interpretation of the wording of the law is stretching it, but not unreasonable, but that law is subordinate to the US Constitution.

I...

Re: Rights during USCG Inspection.

Well, I take offense to your "uneducated" comment. Much "educated" discussion should take place about this anomaly in our law. Besides, most discussion on this website is half-uneducated. that is...

Re: Rights during USCG Inspection.

Under Hiibel v. Sixth Judicial Dist. Court of Nev., Humboldt Cty. 542 U.S. 177 (2004), a person only need identify themselves during a valid Terry stop - when there is reasonable suspicion that a...

Re: Rights during USCG Inspection.

Why do you characterize them as "uneducated?" We could have a discussion of the propriety of 14 USC 89 that could be quite educated. But here, I am just wishing to discuss our actual rights.

Rights during USCG Inspection.

What are our rights during a Coast Guard Inspection? The USCG has the right to stop, board, inspect and make inquiries under 14 US sec 89.

But what are our rights? During my last inspection, I...

Re: Gunboat 55 Dismasted, Abandoned off Hatteras...

Yes, the greenhouse is completely gone. But to be fair, it was always really a hybrid hardtop dodger. The aft section was closed off with only isenglass and canvass.

All in all, that she is...

Re: Departing the slip in reverse singlehanded

It depends on your boat. My Irwin 38 had the kind of rear "Russian roulette" steerage you are talking about. But my Beneteau 47.7 is better backing out of the slip than going forward.

One spring...

Re: Shower Sump

Our 47.7 came with buttons that need to be held pressed for the entire time the pump pumps. That got pretty old, so I just replaced with a toggle switch. To me, it seemed that whoever designed it...

What does profurl have to say? We have a profurl for 15 years, and never a problem in that regard. I keep the halyard tensioned enough to be reasonable both sailing and storing it without adjusting...

West Marine FW-21 Bottom paint instead of VC-17

This year, I bought West Marine FW-21 Bottom paint rather than VC-17. I couldn't tell the difference in any way.

We will see how it goes, but I am always happy to save $20/quart of bottom...
