Re: Slight Rule Change! Editing posts limited to 7 Days. Trial

Seriously, we could have been in breach of the Terms of Service of SailNet.com and we became aware of it.

As you know the modern internet isn't a free for all anymore

See the section in Intellectual Property Rights in the TOS:
https://www.verticalscope.com/aboutu...te=sailnet.com

Instead of shortening the edit period to a few hours or one day we wanted longer. Jeff in particular wanted 7 days because some members use Sailnet on weekends and may miss the error they made in a post last week.

All in all I can't personally see how it affects anyone but if you feel it does please PM me and we'll have a chat

Re: Slight Rule Change! Editing posts limited to 7 Days. Trial

The section I think Mark is referring to reads as follows.

Preservation of Intellectual Property Rights

All material on this site, including, but not limited to images, illustrations and multimedia materials, is protected by copyrights which are owned and controlled by SAILNET.COM or by other parties that have licensed their material to SAILNET.COM. Material from this Web Site or from any other web site owned, operated, licensed or controlled by VerticalScope Inc. may not be copied, reproduced, republished, uploaded, posted, transmitted, or distributed in any way. Modification of the materials or use of the materials for any other purpose is a violation of the copyrights and other proprietary rights held by the respective providers thereof. The use of any such material on any other web site, ftp server or network environment is prohibited.

Look it's a bunch of legal BS and how you actually apply intellectual property to a forum is a grey area.

I guess it means once I hit 'submit reply' on this post Sailnet believe they own it and as per their terms above they don't want us all running around 'modifying their materials' willy nilly?

It's a bit silly and we could get our knickers all twisted but in terms of how I use Sailnet also it is no big deal. As Mark pointed out it's the modern world (Facebook is no different) and the Mod Squad have done their best to make the best of it, minimise impact and also appease the business overlords.

Re: Slight Rule Change! Editing posts limited to 7 Days. Trial

Personally I don't see a problem with this. I also did not know that you could edit at any point in the past. The only times I have ever edited have been within a day, just due to some misunderstanding of what I had previously posted.

One huge suggestion though, and this has bugged the crap out of from day one. Posting pictures is way too difficult, even when they are being hosted somewhere else. Using Photobucket and the like it was easy enough to copy a picture and have it formatted to a certain size to meet Sailnets criteria, but now they charge, and most of my pictures are on Facebook, and other social media sites and the like, which doesn't allow for picture size format change before posting here.

Could something be done to make it automatic? To be able to taking a picture of any size and have SN just format it to meet the forum picture size rules while still having the picture hosted somewhere else would be great. My other option that I am aware of is to start posting all of them to the SN photo albums, thus clogging server space, which I don't want to do either.

Re: Slight Rule Change! Editing posts limited to 7 Days. Trial

My typing is getting worse and worse and I don't even see my mistakes.... often until someone quotes and makes a reply. Then of course I feel like an idiot and want to fix the original post typing or syntax. 7 day window for me makes no sense...and I am not sure what it accomplishes except to discourage content changes...

Re: Slight Rule Change! Editing posts limited to 7 Days. Trial

So… I still don’t understand why this change is being made. Is it because VerticalScope is wanting to enforce or assert its rights under the general Terms of Use?

I don’t want to get all copyright-lawyerish here* but Chall quotes the section from the Terms which asserts VerticalScope’s own claims and limitations of use over their corporate copyright material. It would be a novel interpretation to have this clause apply to the content provided by users, although I suppose this could be one interpretation.

(*I’m not a copyright lawyer, but I have spend decades dealing with copyright issues, most particularly here in Canada where VS is located).

The far more critical clause which users should understand is the grant of rights we agree to give to VerticalScope. It is a very wide grant, which basically means they can do whatever they want with any material users post here, with no obligation (financial or otherwise — with the exception of the protection of moral rights) to the users.

It is not a copyright transfer, however, and the user retains the same rights. So while the license is broad, it is does not mean they own our material.

Quote:
You agree to grant to SAILNET.COM a non exclusive, royalty free, worldwide, irrevocable, perpetual license to reproduce, distribute, transmit, sublicense, create derivative works of, publicly display, publish and perform any materials and other information you submit to any public areas, chat rooms, bulletin boards, newsgroups or forums of SAILNET.COM or which you provide by email or any other means to SAILNET.COM and in any media now known or hereafter developed. Further, you grant to SAILNET.COM the right to use your name and or user name in connection with the submitted materials and other information as well as in connection with all advertising, marketing and promotional material related thereto, together with use on any other VerticalScope Inc. web sites. You agree that you shall have no recourse against VerticalScope Inc. for any alleged or actual infringement or misappropriation of any proprietary right in your communications to SAILNET.COM.
So again, without trying to make a big deal out of all this, I ask: Why is this change being made? Is there something VS is planning which expands their contemplated uses of our submitted material? Or is it b/c mods have run into problems with users altering their posts and then disputing things? These are the reasons that come to mind, but there could be others (which is why I ask the question).

Re: Slight Rule Change! Editing posts limited to 7 Days. Trial

Seems like the classic solution in search of a problem. I suspect a problem occurred on another one of VS’ dozens of sites?

Seems a simple change to the TOU would be more elegant, if it’s self inflicted.

I can’t recall ever needing to go back after 7 days. However, I recall some posts by @Maine Sail that he does edit, as data improves or evolves. Much better than having to sort through hundreds of replies to match the update. Perhaps the “stickies” should be exempt to the OP.

Most modern social media do not tighten the screws down like this, best I can tell.

I don't know now exactly but I think VS has about 300 forums.

The TOS has not changed.

A loophole has been plugged, that's all.

So since when was MarkofSeaLife added to the Mod Squad?

I think this is a good thing even if Mark is not so crazy about it.

Bravo....we used to have someone ( no longer allowed here) who changed the whole meaning of his posts weeks after they elicited responses. This would forever prevent that.
