Do you know their resources?

Regardless, what does that have to do with the law? I doubt Canadian law says that superior property rights are held by the party with fewer resources. It still seems there is more to this story that we haven't heard.

I'm open to this going either way, once all the facts are known. It's too convenient and limited to pick on the yachties by default.
